Article 1 – Purpose

These terms and conditions govern the sales on the website Tchibook.com.

Article 2 – Prices of ebooks

The prices of our ebooks are displayed in euros including all taxes (VAT). Local taxes and processing fees may apply to all or part of our ebooks. All ebooks and all fees are payable in euros only.
Tchibook.com reserves the right to change its prices without notice. However, an ebook ordered before a price change will be billed based on the rate in effect at the time of order validation.
The ebooks remain the property of Tchibook.com until full payment of the order.

Article 3 – Ordering ebooks

Orders for ebooks are made exclusively on the website Tchibook.com by following the successive steps: cart validation, billing details validation, online payment, etc. Payment of orders is made exclusively online by credit card or PayPal.
Orders and payments by other means (telephone, email, postal mail, etc.) are not accepted.
The contractual information is presented in the language of the website. They are subject to confirmation at the latest at the time of order validation.
Tchibook.com reserves the right not to record a payment and not to confirm an order for any reason whatsoever, in particular in the event of a technical problem or difficulty concerning the order received.

Article 4 – Acceptance of the General Terms and Conditions

An order placed on the website Tchibook.com implies acceptance of the General Terms and Conditions of Sale (GTC). Any order confirmation results in the full and unconditional adherence of the customer to these general terms and conditions of sale, without exception or reservation.
All the data provided and the recorded confirmation constitute proof of the transaction.

Article 5 – Downloading ebooks

Ebooks are available for download after order validation.
A download link is automatically sent by email to the customer after payment. The link is also available on the order confirmation page.
The download link is valid for 24 hours after payment.
The customer agrees to:
– provide a valid and functional email address to receive the download link.
– download the ordered ebook within a maximum of 24 hours following payment.
– save the ebook on a digital medium after downloading to ensure its permanent preservation.
Any loss or failure of the ebook due to the customer’s responsibility will not entitle them to a new copy.

Article 6 – Reading License

The purchase of an ebook grants the customer a non-exclusive and non-transferable license to download and read the ebook on any personal device.
This license does not allow the customer to share, resell, or distribute this ebook to third parties.
The customer is authorized to make a backup of the ebook for personal purposes.
Markings are integrated into the ebook at the time of purchase to ensure protection against any illegal use.

Article 7 – Non-applicable Right of Withdrawal

In accordance with Article L. 221-28 of the Consumer Code, the 14-day right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium, the execution of which has begun after the consumer’s prior express agreement and express waiver of their right of withdrawal.
By validating their order, the customer expressly acknowledges waiving their right of withdrawal. This waiver is irrevocable.

Article 8 – Liability

The ebooks offered comply with current French legislation.
The website Tchibook.com cannot be held responsible for damages resulting from a misinterpretation of the information contained in the ebooks.
The website Tchibook.com declines all responsibility for the use that the customer could make of them and the consequences that could result from it.

Article 9 – Applicable Law in Case of Disputes

The original language of this contract is French. These terms and conditions of sale are subject to French law. In the event of a dispute, the French courts shall have sole jurisdiction.

Article 10 – Intellectual Property

All elements of the website Tchibook.com are and remain the exclusive intellectual property of Tchibook.com. No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, elements of the site whether they are software, visual, or audio. Any simple or hypertext link is strictly prohibited without the prior written consent of Tchibook.com.

Article 11 – Personal Data

Tchibook.com reserves the right to collect nominative information and personal data concerning the customer. They are necessary for the management of the order, as well as for the improvement of the services and information we send to the customer.
They may also be transmitted to companies that contribute to these relations, such as those responsible for the execution of services and orders for their management, execution, processing, and payment.
This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the law of January 6, 1978, the customer has the right to access, rectify, and oppose the nominative information and personal data concerning them.

Article 12 – Archiving and Evidence

Tchibook.com archives order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
The computerized records of Tchibook.com will be considered by all parties concerned as proof of communications, orders, payments, and transactions between the parties.
